• Jacob D. Jerde, 27, of Hibbing, charged and sentenced for gross misdemeanor possession of a controlled substance in the fifth degree on Oct. 8, 2018. Sentenced by Judge Mark M. Starr to a stay of adjudication with three years probation with conditions including 13 days jail, $135 in fines, no alcohol or controlled substance use, no mood-altering chemicals without a doctor’s prescription, no possession of drugs or alcohol, random testing upon request and pay for said test, do not enter bars or liquor stores/establishments whose main source of income in alcohol, attend Alcoholics and Narcotics Anonymous as directed, no same or similar violations, remain law-abiding, follow all instructions of probation, chemical dependency evaluation and treatment, follow recommendations of evaluation, follow all program/institution rules, follow all state and federal criminal laws, contact your probation officer as directed, tell your probation officer within 72 hours if you are charged with any new crime, if you change your address, employment or telephone number or have contact with law enforcement; cooperate with the search of your person, residence, vehicle, workplace and things as directed by your probation officer; sign all releases of information as directed.

• Bradley D. Swatek, 40, of Hibbing, convicted of misdemeanor disorderly conduct on Oct. 8, 2018. Sentenced by Judge Mark M. Starr to 90 days jail stayed, one year probation with conditions including $285 in fines, no same or similar violations, remain law-abiding and do not cause harm or fear in anyone.

• Joseph S. Nitzschke, 30, of Chisholm, convicted of gross misdemeanor possession of methamphetamine in the fifth degree on Oct. 8, 2018. Sentenced by Judge Rachel C. Sullivan to 90 days jail and $135 in fines. Sentenced to be served concurrently with other charges.

• Carlene M. Herring, 55, of Duluth, convicted of misdemeanor disorderly conduct on Oct. 8, 2018. Sentenced by Judge Mark M. Starr to 58 days jail and $135 in fines.

Felony Convictions

• Richard C. Allen, 59, of Hibbing, convicted of felony possession of hydrocodone in the fifth degree on Oct. 4, 2018. Sentenced by Judge Mark M. Starr to 19 months Commissioner of Corrections stayed, one year probation with conditions including 137 days jail.

• Constance M. Carlson, 47, of Grand Rapids, convicted of felony manufacturing methamphetamine in the first degree on Oct. 4, 2018. Sentenced by Judge Mark M. Starr to 74 months Commissioner of Corrections, $135 in fines, supply DNA sample and restitution reserved for 60 days.

Assault Convictions

• Jeffrey L. Politano, 60, of Hibbing, convicted of gross misdemeanor assault in the fifth degree on Oct. 8, 2018. Sentenced by Judge Mark M. Starr to one year jail stayed, two years probation with conditions including 57 days jail and $135 in fines.

• Kirbie M. Walker, 33, of Gheen, Minn., convicted of misdemeanor domestic assault on Oct. 8, 2018. Sentenced by Judge Mark M. Starr to 90 days jail stayed, two years probation with conditions including two days jail, $35 in fines, no alcohol or controlled substance use with the exception of prescribed medications, no possession of drugs or alcohol with the exception of prescribed medications, do not enter bars or liquor stores/establishments, no contact with victim(s) without prior approval of probation officer, domestic abuse evaluation and follow recommendations, no threats of violence, no same or similar violations, remain law-abiding, follow all instructions of probation, follow all state and federal criminal laws, contact your probation officer as directed, tell your probation officer within 72 hours if you are charged with any new crime, if you change your address, employment or telephone number or have contact with law enforcement; cooperate with the search of your person, residence, vehicle, workplace and things as directed by your probation officer; sign all releases of information as directed; and no use or possession of firearms or dangerous weapons.

DUI/DWI Convictions

• Eric J. Hyttinen, 33, of Hibbing, convicted of misdemeanor fourth degree DUI/.08 or more within two hours of driving on Oct. 8, 2018. Sentenced by Judge Mark M. Starr to 90 days jail stayed, one year probation with conditions including two days jail, $610 in fines, no alcohol or controlled substance use, no mood-altering chemicals, no possession of drugs or alcohol with the exception of prescribed medications, random testing upon request and pay for said test, submit to random searches, no drinking and driving, no driver’s license violations, no driving without insurance, do not enter bars or liquor stores/establishments, no same or similar violations, remain law-abiding, follow all instructions of probation and report to agent as directed.

• Steven F. Jackson, 53, of Hibbing, convicted of gross misdemeanor DWI on ATV/snowmobile//.08 or more within two hours of driving on Oct. 8, 2018. Sentenced by Judge Mark M. Starr to one year jail stayed, two years probation with conditions including 15 days jail, $615 in fines, no alcohol or controlled substance use, no mood-altering chemicals, no possession of drugs or alcohol with the exception of prescribed medications, random testing upon request and pay for said test, submit to random searches, no drinking and driving, no driver’s license violations, no driving without insurance, do not enter bars or liquor stores/establishments whose main source of income in alcohol, victim impact panel, no same or similar violations, remain law-abiding, follow all instructions of probation and report to agent as directed.

• Jordan D. Spector, 27, of Chisholm, convicted of misdemeanor fourth degree DWI on Oct. 1, 2018. Sentenced by Judge Mark M. Starr to 90 days jail stayed, one year probation with conditions including two days jail, $615 in fines, follow recommendations of evaluation, no alcohol or controlled substance use, no mood-altering chemicals, no drinking and driving, no driver’s license violations, chemical dependency evaluation and treatment, complete within 60 days, provide verification within one year to attorney to file with the courts, no possession of drugs or alcohol without a doctor’s prescription, random testing upon request and pay for said test, cooperate with the search of your person, residence, vehicle, workplace and things as directed by your probation officer; no driving without valid driver’s license and insurance; remain law-abiding; do not enter bars or liquor stores/establishments whose main source of income in alcohol; follow all instructions of probation; report to agent as directed; no same or similar violations; victim impact panel; $400 cash bail to be be applied directly to the fine; and no drink/no bars may be modified by probation if chemical report shows there are no issues.

• Joseph S. Nitzschke, 30, of Chisholm, convicted of misdemeanor DWI on Oct. 8, 2018. Sentenced by Judge Rachel C. Sullivan to 90 days jail and $135 in fines. Sentenced to be served concurrently with other charges.

• Sean A. Cochrane, 40, of Tower, convicted of misdemeanor fourth degree DWI on Oct. 4, 2018. Sentenced by Judge Mark M. Starr to 90 days jail stayed, one year probation with conditions including three days jail, $61o in fines, no mood-altering chemicals, no alcohol or controlled substance use, no possession of drugs or alcohol without a doctor’s prescription, random testing upon request and pay for said test, cooperate with the search of your person, residence, vehicle, workplace and things as directed by your probation officer; no drinking and driving; no driving without valid driver’s license and insurance; chemical dependency evaluation and treatment; follow recommendations of evaluation; do not enter bars or liquor stores/establishments whose main source of income in alcohol; follow all instructions of probation; report to agent as directed; no same or similar violations; victim impact panel; and remain law-abiding.
